TVS Flame: Fire starter

TVS Flame 125 image from tvsflame.comThis is the motorcycle that has Bajaj and TVS all stirred up. Sadly, it isn't because the damn thing's so good looking. Hmph. The nub of the matter is that the TVS has two spark plugs and a third valve – an inlet that opens later, sort of like VTEC. No all that's wrong. What happens is that TVS' carburettor opens into two vertically stacked manifolds that lead to the two intake valves, one each. As the carburettor slide rises on throttle application, the fuel-air mix first begins to travel down the lower one, the 'swirl port' as TVS calls it. This port is designed to operate with maximum swirl, generating maximum possible turbulence to allow the engine to offer great economy and torque. As the revs (and the slide) continue to rise, the carburettor begins to feed the motor through the other manifold, the 'power port'. This port is straigher compared to the curvy swirl port, and it's job in life is to flow more mixture. At high revs, this allows the engine to breathe deeper and make more power.

I haven't had any saddle time, but am told that the torque levels are admirable. In many respects, this might be the best looking 125 on the market soon. Launch is expected by November. The rest of the text is from TVS. And the photos are all from here.

Sorry, but I haven't any pics for the Star City 110 yet. To describe it, it has an edgier looking front-end with a more square headlamp and an iffy horse graphic that runs from the knee recess down to the sidepanel. TVS Apache RTR FI: The 160 gets fuel injection!

TVS Apache RTR 160The pic is the old Apache. You see, the the RTR FI only sports a new set of stickers to separate it from the normal carburetted RTR. The other difference visually being the optional rear disc should you opt for one. The price difference has not been announced but I would put the estimate at between Rs 3,000 (brilliant pricing) and Rs 5,000 (all right). The extra money goes towards even better midrange and top-end and very, very crisp throttle response. The launch is expected to arrive and capture the Diwali rush.

The new Apache EFI
TVS Motor Company is for the first time offering Electronic Fuel Injection technology in the 160cc category. The new technology, which consists of an Electronic Control Unit (ECU) made up of sensors, fuel pump and injector. ECU receives the data from sensors, processes them and delivers optimum fuel and ignition timing. The Electronic Fuel Injection technology offers better engine smoothness, faster throttle response, lower emissions, good cold start and recovery, better idle stability, good drivability, better fuel economy and performance consistency at various altitudes and environments. The Apache RTR EFI also offers instantaneous response throughout the rev range. Another first time offering in this segment would be the rear disc brake facility.

TVS Responds to Bajaj

TVS has responded overnight to Bajaj's statement yesterday with this

TVS Motor is surprised at the wild and reckless allegations made by Bajaj Auto Ltd through the media charging TVS Motor with infringement of their intellectual property rights. The accusation is a malicious attempt to tarnish the fair name of TVS Motor and its promoter group TVS which has established reputation for highest standard for business ethic. Rebutting the malicious charge, TVS Motor had forthwith put Bajaj on notice that the accusation is libelous, asking them to withdraw the reckless charge or face law suit.

Even though the press statement issued on 9/1 explains the facts briefly, the management of TVS Motor considers it its duty to place the correct facts before all our stake holders and the public, so that they can judge for themselves how irresponsible the charges against us are and also to reaffirm our commitment to the highest standards of ethics in the conduct of business.

Our statement through the media on 9/1 had pointed out that that the allegation of Bajaj Auto was baseless and ridiculous would be evident from their own admission that the invention, which they claim has been infringed by us, is a known technology extensively in use all over the world for several decades. We had added that, under the Patent Law, this is known as 'prior art'. Inventions or works of 'prior art' are not patentable under the laws of India.

That ours is a technology company is self-evident from the fact that it was TVS Motors that had first developed the wholly in-house technology for and produced the first Indian Motorbike, the Victor, as early as 2002. The same was the case with the indigenous TVS Moped which the company developed during the days of the controlled economy and it is even today the most sought after small vehicle. We are firm believers in technology and we also believe in continuously upgrading it. We have been investing over 2.5% of our gross revenues in R&D activities and have a compliment of over 500 qualified engineers engaged in research and for new product developments. So in the field of technology TVS Motor actually enjoys the first mover position and we do not have the need to look anywhere other than our own R&D room for new technologies. But, since a reckless allegation has been made it is our duty as management of TVS Motor to formally tell its stakeholders that the technology developed by it does not in any way infringe the patent claimed by Bajaj Auto. The new technology of TVS Motor has been developed along with globally renowned engine research institute – AVL, Austria – and it is totally different from the technology used by Bajaj Auto. The brief explanation that follows will make evident.

If the correct facts of Bajaj Auto claim of patent are captured, that will be sufficient to disprove their charge. Bajaj Auto had, at first, filed a complete final claim for patent for its "DTSi" technology on 3rd July 2003 stating that "An improved internal combustion engine for efficient burning of lean air fuel mixture used in engines working in four stroke principle, characterized in that said IC Engine comprising of…. " But this was not the invention for which the patent was granted. Had they got the patent for this, which they could not have as this was, in patent law a prior art, then they could perhaps have claimed only they could use the two spark plug technology. But what happened was something else.

Before the grant of patent, Bajaj Auto Ltd had to amend, and in fact amended, its complete final claim on 5th November 2004, wherein Bajaj Auto Ltd reduced its claim to "An improved internal combustion engine for efficient burning of lean air fuel mixture used in engines working in four stroke principle, having two valves, characterized in that said IC Engine comprising of….,". This is critical. The patent, as granted rests on the two valves as the distinct new feature, not on the two spark plugs.

Thus Bajaj Auto's final claim to patent is based on "two valve engine". In contrast, TVS Motor's Internal Combustion Engine has three valves. In addition to this fundamental differential, which makes all the difference in law, each and every element of Bajaj Auto patent claim description, including "twin spark plugs", rests purely on "prior art". On a comparison of Bajaj Auto IC Engine with TVS Motor IC Engine, and also by applying the doctrines of all 'element rules' and 'equivalence' under Patent Law, any charge of "infringement" against TVS Motors by Bajaj Auto is clearly ridiculous.

Shortly stated, the patent rights claimed by Bajaj Auto Ltd for its Internal Combustion Engine is not for 'twin spark plugs' per se. It is for the use of twin spark plugs in two valve engine. On the other hand, TVS Motor's technology is a combination of its in-house developed innovative technology by name "VTi", and use of AVL's patented "3 Valves" technology in engine.

Notwithstanding that the patent claimed by Bajaj does not impact on the technology it has developed, TVS Motor has, based on legal advice, moved an application to revoke the patent granted to Bajaj Auto Ltd on the ground that patent claimed by Bajaj Auto Ltd is a known 'prior art'.

The most surprising part of the story of the irresponsible charge is that Bajaj Auto does not even know what is the configuration of the TVS Motor's new technology "CCVTi". And yet it has taken a leap in the dark and made such a serious allegation. TVS Motor is therefore insisting on Bajaj Auto withdrawing its malicious charge. If they do it TVS Motor will leave it at that. Otherwise it will go ahead with its libel suit. Again TVS Motor will ensure, by appropriate legal means, that Bajaj Auto does not interfere with its use of its in-house VTi technology on the basis of which it has already announced new launches commencing from November.

Another statement from Bajaj

In continuation of its Press Release of Monday 4th September 2007 concerning the following matter, Bajaj would like to state as follows –
  1. Bajaj continues to be anxious about and prepared to defend its DTS-i (Digital Twin Spark – ignition) patent in the event of any attempted infringement, as it has successfully done in recent years.

  2. This will be clearly and finally evident only if and when an offending product is actually launched.

  3. Bajaj anticipates that in view of its having articulated its intentions in no uncertain terms, no such offending product would be launched.

  4. Thus, for now Bajaj has no further comment to offer on this matter until such launch.

  5. Bajaj considers it unfortunate that hitherto healthy competition has deteriorated in this manner.

PRESS RELEASE

Bajaj would like to clarify the following in the context of its concerns over possible infringement of its DTS-i technology –
  1. Bajaj believes that the use of twin spark technology, christened Bajaj DTS-i (Digital Twin Spark – Ignition), in small automotive engines is worthy of intellectual protection.

  2. It had thus applied for the same for the Indian market on July 16, 2002 and was granted approval via patent number 195904 on July 7, 2005. If there exists any application for revocation of this patent, details of the same are not known to Bajaj.

    Similarly, it is also expecting approval of its international patent applications in various foreign countries subsequent to its application PCT/IN03/000348 dated October 30, 2003.

  3. By virtue of the presence of DTS-i technology, Bajaj motorcycles including the Discover, Pulsar, and Avenger, have made Bajaj the leader not just in the premium (125 cc – 250 cc) motorcycle segment in India, but also in exports.

  4. Given this success, various global manufacturers have in recent years attempted to imitate and thus infringe upon Bajaj technology/products, and Bajaj has and will continue to thwart them.

    Most recently Chinese manufacturer Taian Chiran Machinery Co ltd. and its Sri Lankan distributor were instructed by the honourable High court of Western Province, Sri Lanka to withdraw their copy of the Bajaj Pulsar with DTS-i technology from the market.

  5. Bajaj has been anxious that failing domestic manufacturers may in an act of desperation adopt similar dubious methods in India.

  6. Bajaj is preparing to defend its intellectual property in the event that such a product is eventually introduced. At that time, if evaluation of the actual product appears to suggest reasonable grounds for infringement, Bajaj will take all necessary steps to safeguard its interests as also to inflict the maximum permissible damage upon the offender so as to set an effective precedent for the future.

  7. Bajaj accords the highest importance to its IP portfolio and will defend the same. Bajaj cautions against any attempt to infringe.

TVS Flame: stunning... & a storm-bringer too

TVS Flame Tail PipeTVS showed off the smashing new 125cc Flame er.. how do I put it? Yesterday. The smashing looking bike looks like a cross between the KTM and B-King and many other things. And visually it's a stunner. Forget the good-looking RTR, the Flame is even better looking. However, the CC-TVi, or was it CC-VTi thing has run into trouble.
